Litigation

Litigation is the attempt by means of legal proceedings to resolve a dispute or to claim damages for a wrong that has been suffered. We will advise you whether or not to embark on litigation and also whether or not you qualify for legal aid. In many cases it may be better to compromise your differences and settle for a reasonable sum rather than going all the way to a full Court hearing.

In some cases we may have to advise you that the law is not on your side. We may take a Barristers’ opinion in your case. We must warn you that there can be long delays in litigation, months or even years. However sometimes delay is necessary in your interest. For example, if you have suffered an injury it may take some time before its extent and effects are known. Once a settlement is reached, the case cannot be re-opened, even if an alarming new symptom subsequently appears. We will also advise you in relation to Court timetables, and delays caused by back-logs in the Court system.

The partners in this office are qualified as Arbitrators and Mediators and can offer these services as an alternative to litigation. These methods can offer a quicker and cheaper alternative to the courts in some instances and we can advise you where and when they should be used
